/*AOL makes first changes to TOS since 1998

Here is a copy of the email that just went out to AOL members:

Dear Member,

To keep pace with the many changes that sweep through the online world, AOL must occasionally update our Member Agreement, also known as the Terms of Service (or TOS) -- the terms that govern our relationship with our members. We have not updated that agreement in more than five years, since 1998.

However, the evolution of our business and services, changes in recent law, and commitments that we need to fulfill with our vendors demand that we change it at this time.

We have taken the opportunity to update our Community Guidelines to make them easier to understand. The basic philosophy remains the same -- to be respectful of others online. We have distilled the guidelines into four principles and added links to resources to help you best manage your online experience. Please take the time to review the Community Guidelines at AOL Keyword: TOS. Also remember that anyone using your AOL account should review these as well.

Please note that these changes, which take effect August 3, 2003, do not involve a price increase.

WHAT'S CHANGED

Specific changes to the Member Agreement are summarized below. In addition, we have reorganized the Member Agreement to make it easier for you to understand what rights and obligations you have as an AOL member.

Complete information about these changes, as well as the full updated Member Agreement, will be made available at AOL Keyword: TOS. If you prefer to review a translated version of the Member Agreement in Spanish, you will be able to do so shortly at AOL Keyword: TOS. {sic}

We've tried to minimize the "legalese" in this summary, but we know you may still have questions or other feedback.

To ask questions about the Member Agreement, please visit AOL Keyword: TOS, click on the button labeled "Questions?" and then click the "Ask the Staff" button.

To send us general feedback about the AOL service, please visit AOL Keyword: Tell Us What You Think.

SUMMARY OF CHANGES TO THE MEMBER AGREEMENT

* We are committed to fighting spam, and we want to be sure that we can fight not only e-mail spam but also other forms of spam you might receive. Our Member Agreement always made clear that we do not tolerate spam. We updated the Member Agreement to make sure that our members understand that none of our communications tools should be used to send spam, whether by e-mails, in chat areas, or by instant messages.

* As you know, we and our partners are providing great new entertainment, communications and software features on AOL. The changes to the Member Agreement explain in more detail what legal rights you have with these features and what obligations you have when you use and access these features

* Similarly, we provide more detail on the rights you have when you put content on the AOL service (such as a posting on a message board) as well as the rights and obligations you have when you use the content owned by others, like photographs and music.

* We've simplified the billing section to make more options available in the future on how you can pay for your AOL membership.

* We have always disclosed what warranties we can and cannot offer you with the AOL services. To fulfill our obligations with our partners, the new Member Agreement also defines what warranties our partners believe should be disclaimed in exchange for making software, features and services available to you.

* We have always disclosed what liabilities we are not willing to assume. Again, to fulfill our obligations to our partners, we disclose what liabilities our partners are not willing to assume when they make their products available to us for use with the AOL service

* To comply with new and pending state laws, we note that all AOL members authorize the collection, use, and disclosure of personal information by AOL as provided in AOL's Privacy Policy.

* We want to make sure that you understand that certain extra costs may be involved when you access AOL services from a variety of communications services, like phone lines, toll free numbers or wireless services. For this reason, we created a new section to discuss communications charges.

* You probably take for granted that you have been communicating electronically with AOL since you first started the service. Recent laws require that we make sure you remain willing to communicate and transact with us electronically. Therefore, we added a new electronic notice policy in the Member Agreement.

For more specific and extensive details on the changes made to the Member Agreement, please visit AOL Keyword: TOS Changes.

Again, the new Member Agreement will take effect on August 3, 2003, after which date it will govern you and all authorized users of your account, as well as other members of the AOL service. If you do not agree to the new terms, you will need to cancel your membership before the changes take effect.

Thank you for being an AOL member.

AOL still has the most members of any internet service provider, weighing in at more than 30 million members.

Spam up 500% in last 2 years
When I read articles like this one:
BBC NEWS | UK | Politics | MPs uncover seedy world of spam it helps to validate my almost daily inbox feeling of dread that I have to sift through literally hundreds of filtered spam emails (this is after they got through my spam filters). Overnight I received 300 filtered emails of which only *2* were legitimate emails!

I'm not the only one this happens to, it happens to anybody with an email account. I still have one of the very early email addresses when I got onto the web and that things get pounded worse than your neighborhood possum crossing the road.

So what are the solutions? I think some stiff penalties for people that the article describes as prolific fraudsters. "To be eligible for registration, the guilty have to have been thrown off three consecutive internet service providers (ISPs) for spamming."

Thrown off 3 consecutive ISPs for spamming? I think a three strike rule with these folks is in order. Somebody take away their PC privileges after 3 strikes.

I don't know what's going to happen with spam, but I think it's just a matter of time before the government steps in like they are eventually going to do with online gambling.

LeeNoga.com - BLOGS ??? - All this talk 'bout em - LeeNoga busts out with a very good thread at her new self-titled board

Lee doesn't seem to see the value in starting a blog in this thread. I think more of the techie-webmaster folks have gravitated to this initially, but more and more webmasters are catching onto the fact that blogs can be relevant and useful, not to mention bring in an additional traffic from the search engines that wouldn't otherwise be available.

With popups under siege by all the popup blockers, my thinking is why not divert your attention to starting something new and different to generate some SE traffic.

Dravyk and Electra who own/operate allofem has run a microjournal-style blog for a couple years now with their board reviews section. This is an adult webmaster resource example of a blog, though they use their own software and don't refer to it as a blog.

washingtonpost.com: Web Firms Choose Profit Over Privacy - stories like this one piss me off. I mean how can you forget to update your privacy policy when it comes to such a major change as this?

I've had site owners (well known webmasters) tell me that if their site is offering free content then they have every right in the world to spam their webmasters on the list whenever they feel right.

Er, well not if you don't tell them in advance this is your practice! Hooked on Phonics must have gone to the yahoo school of privacy updating. I just hate it when privacy policies are updated and the information DEFAULTS back to you being auto-subscribed for everything. Again, if they told you this was the way it was going to be, that would be ok!

Where is the common sense in something like this? Hooked on Phonics should now be called: Hooked on Laziness!

So they can teach my kids how to read better but they can't teach themselves how to update their own privacy policy?

Online media morals
When I read this article on the subject of online media morals and the comparison to radio and TV it made me stop and think. There is something to the fact that people who are behind keyboards are more courageous than those in the print and TV where they are held more accountable for their actions.

Is online media as reliable as TV, radio and print? I know with my Script School Radio show I had to take a stand with advertisers back on show #41 where an advertiser had threatened to pull advertising if I had a certain guest on the show. I had the guest on the show and said that if anybody thought they would dictate to me who was and was not going to be on the show then they weren't the type of advertiser I wanted to have on. Of course I was more animated when I said it back then, but that was the gist of the conversation.

New California disclosure law effective July 1, 2003
SB 1386 Senate Bill - CHAPTERED - this will require to quote:

"This bill, operative July 1, 2003, would require a state agency,
or a person or business that conducts business in California, that
owns or licenses computerized data that includes personal
information, as defined, to disclose in specified ways, any breach of
the security of the data, as defined, to any resident of California
whose unencrypted personal information was, or is reasonably
believed to have been, acquired by an unauthorized person."

These are the methods by which the responsible party who didn't protect the consumer's personal information must notify the affected consumer:

"(A) E-mail notice when the agency has an e-mail address for the
subject persons.
(B) Conspicuous posting of the notice on the agency's Web site
page, if the agency maintains one.
(C) Notification to major statewide media."

I wonder how long before other states adopt similar legislation?

/* I hear the question a lot: what is a blog? Blogs are short for "weblogs" and the content for them could be several different common types: microjournal, notebook or filter.

1) a regularly updated microjournal. It sort is like what someone is up to, what they are doing and not always of much value except to those who know that person or are wondering what they might be doing. This is a useful type of blog for say an amateur woman, man or couple with an adult site so they can tell their members what they are doing.
2) A notebook which has more essay-type entries with opinions on various sides of life, business, etc. Some news organizations cite these type of blogs as an example of trends. Sort of like most of the copies of posts here at tdavids.com.
3) The third type is called a filter. These are a hyperlink to another page often with some type of comment. Very similar in origin to a links list but perhaps with a bit more commentary.

PC Magazine has several informative articles on blogs: currently in the June 30, 2003 Issue (page 60-61) Building Blogs
